Welcome to E-clair. These Terms and Conditions constitute a legally binding contract between you and E-clair. By downloading, installing, accessing, or using the application and its associated backend API infrastructure, you agree to be bound by these Terms in their entirety.
If you do not agree to these Terms, you are strictly prohibited from utilizing the Service.
Description of Service
E-clair is a language-learning utility designed to assist users in achieving language proficiency through media-delivery integration, automated speech-to-text alignment, contextual dictionary parsing, and custom vocabulary notebook tracking. The Service is provided solely for personal, non-commercial, educational use.
Eligibility & Account Security
Age Requirement
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use this Service. If you are under 18 years of age, you represent that you have reviewed this Agreement with a parent or legal guardian who accepts these Terms on your behalf.
Authentication
To access personalized features, you must authenticate through our supported third-party identity providers. You are entirely responsible for maintaining the confidentiality of your session states and authentication parameters. You agree to immediately notify us of any unauthorized access or security breaches involving your account.
Intellectual Property Rights & Public Media
Public Directory Content
E-clair utilizes decentralized third-party directory systems to discover, parse, and stream publicly distributed RSS podcast feeds. E-clair does not host, clone, or permanently store the underlying media audio binaries, publisher artwork, or show notes on its public servers. All copyrights, trademarks, and intellectual property rights in the streamed media belong exclusively to the original content creators and publishers.
Educational Fair Use & Transcription
The Service allows you to trigger automated, temporary speech-to-text transcription of public audio streams. These machine-generated transcripts, structural alignments, and translations are compiled dynamically at your explicit command and are intended solely for your private, individual, non-commercial educational study under applicable Fair Use principles. You are strictly prohibited from exporting, republishing, selling, or publicly distributing machine-generated transcripts of copyrighted media files.
Proprietary App Software
The E-clair client code, application layouts, interface designs, brand logos, custom backend architecture, database schemas, and proprietary compilation stacks are the exclusive intellectual property of E-clair.
User-Generated Content & Imported Media
User Ownership
You retain full ownership and intellectual property rights over any personal audio snippets, text files, or custom vocabulary notes that you manually type, import, or upload into the Service (collectively, "User Content").
Processing License
By processing User Content through our platform, you grant E-clair a worldwide, royalty-free, non-exclusive license to securely transmit, cache, parse, and modify said content solely to the extent necessary to deliver the requested app functionality (such as rendering text or generating a local transcription).
Copyright Compliance
You explicitly warrant and represent that you possess the necessary legal rights, file licenses, ownership, or valid fair-use exemptions to process any media file you choose to import into the Service. E-clair explicitly disclaims all liability for copyright infringement, unauthorized reproduction, or legal non-compliance resulting from user-uploaded or user-imported files.
AI-Generated Data & Limitation of Liability
Nature of Machine Learning: You explicitly acknowledge and agree that the transcription alignments, context-aware dictionary definitions, grammatical breakdowns, and verb conjugation tables provided within the App are compiled or augmented via automated machine-learning models and programmatic translation scripts.
"As-Is" Provision: The Service is provided entirely on an "as-is" and "as-available" basis. E-clair makes no warranties, representations, or guarantees — express or implied — regarding the absolute semantic accuracy, translation precision, typographic correctness, or system completeness of the machine-generated data.
Disclaimer of Damages: To the maximum extent permitted by law, E-clair shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of academic or professional standing, or software downtime, arising out of or relating to your reliance on linguistic data generated by the Service.
Acceptable Use & Rate Limiting
You agree to navigate the Service exclusively in a standard, manual human fashion. Prohibited activities include, but are not limited to:
Deploying automated scraper bots, spiders, or scripts to systematically extract vocabulary, audio streams, or compiled dictionary databases from our endpoints.
Attempting to bypass local application barriers, inject malicious code into backend server routing, or spoof authentication protocols.
Subjecting our backend API endpoints to unreasonable, rapid, or programmatic query loads designed to artificially trigger transcription engines or translation pipelines.
E-clair reserves the absolute right, in its sole discretion, to enforce rate-limiting measures, temporarily restrict features, or permanently terminate user accounts without prior notice if a user exhibits behavior that threatens the financial, operational, or computational integrity of the Service.
Severability
If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that specific provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
Modifications to These Terms
We reserve the right, at our sole discretion, to modify, update, or replace any portion of these Terms and Conditions at any time to align with software updates or regulatory shifts. When updates occur, the "Last Updated" date at the top of this document will be adjusted. Continued usage of the Service following the publication of changes signifies your formal acceptance of the revised Terms.
